Description
Commitment to equality and social justice was of utmost importance to the Constitution framers. For this reason, the Constitution not only provides anti-discrimination provisions under Articles 15 and 16 but also authorises the State to provide special benefits and preferences to backward sections of the population. Reservation has been the preferred mechanism to instill social justice despite multiple challenges. It becomes more perplexing in the case of OBC reservation, especially after the Supreme Court legitimised caste as the primary indicator of social and educational backwardness. The book aims to examine Constitutional aspects of OBC reservation policy and jurisprudence in India. It undertakes a conceptual and philosophical examination of equality as a political and legal ideal and identifies the position of reservation/quota within the larger paradigm of substantive equality of opportunity. The book traces the historical evolution of the reservation policy in India along with its Constitutional and judicial development. Further, it engages with issues pertaining to the identification of the backward classes, the judicial analysis of class and caste jurisprudence. It further examines other matters relating to the extent and quantum of OBC reservation.

Dr. Sakshi Parashar is currently working as an Assistant Professor- Law with Symbiosis Law School, Noida, Symbiosis International (Deemed University), where she teaches Constitutional Law and Comparative Constitutional Law. Sakshi completed her Ph.D. (Law) from the Indian Law Institute, New Delhi, and has prior teaching/Research experience working with the Amity Law School, Noida, Amity University, Uttar Pradesh, Lloyd Law College, Greater Noida, Indian Law Institute, New Delhi (as Senior Research Fellow). She has also worked as an in-house counsel for energy companies like Noida power Company Ltd. and GMR Energy Ltd.
