Description
Along with Special Chapters on Bail under Dishonour of Cheques and Acquittal of Accused
It is of great pleasure and satisfaction for us to have been associated with S. Krishnamurthi Aiyar's treatise on Negotiable Instruments Act for more than a decade as we have been revising the same since its ninth edition. The 13th edition of the Law Relating to the Negotiable Instruments Act, 1881, is now in the hands of the esteemed readers. We have taken special care to improve the commentary in section 138, both qualitatively and quantitatively. We have shifted some major headings and rearranged the minor headings in Section 138 and have also correlated the relevant headings of Section 138 in Section 139. The recent amendment in Section 6 regarding a cheque in the electronic form has been appropriately dealt with. To clear the controversy and criticism arising out of Dashrath Rupsingh Rathod's case/ the legislature has made amendment in section 142 by inserting sub-section (2) in relation to the jurisdiction of courts for the purpose of entertaining a criminal complaint filed under section 138 of the Act. The same has also been dealt by giving the earlier position and the present position. Section 142A has also been inserted validating the transfer of pending cases by the Ordinance. The case-law has been updated upto March 2016. We believe that this new edition of the book will be of great use to the readers.
