This Book, "Law Relating to Presumptions, Burden and Proof of Documents" is being released by way of Fourth Edition. In the present edition some new chapters had been added. The decisions relevant had been place at the appropriate places. The suggestions given for
the further improvement of this book by The Bar and The Bench too had been kept in mind while revising this edition. In Dharmaji Shankar Shinde and others v. Rajaram Shripad Joshi (Dead) Through LRs. and others, AIR 2019 SC 2367, it was held that a "mortgage by conditional sale", the transfer is made as a security to a loan taken by the mortgagor-owner; whereas in a "sale with a condition to repurchase", the sale is made by the vendor-owner reserving with himself a right to repurchase it within a stipulated time."
