Description
Law can be used as a potent tool to take the poor segment of our population towards development. Any scheme or step for poverty alleviation would only be uniformally applicable and realistically attainable, if it is in tune with the law and is under the Constitutional mandate. As such, there is an imperative need to accord due emphasis to the existing legal regime for all developmental processes and activities. This effort is meant to discuss the issues concerning legal aspects of poverty eradication and development. I would like to share what led me to write this book. "Law, Poverty and Development" is one of the subjects specified by the Bar Council of India for the law students. It is a paper in the LL.B. curriculum. I was assigned to teach this subject at Amity Law School during 2010. There were no books in our library on this subject. I went to various law books hops. They too had no books to offer. I sought help from National Law Schools, one of the Foremost in this regard. Some study material was sent by their Vice-Chancellor. It was a mere compilation of a few articles published indifferent newspapers and journals. Other Vice-Chancellors and Deans of Law Schools were also not of much help. I had therefore little option but to prepare my own material. The same is in the form of this book. The book is a humble and simple effort to serve the above purpose. It is meant to carry out and appraisal of the available legal regime. It enumerates the shortcomings and inadequacies of the applicable laws. The recent decision by the Supreme Court in the matters of land acquisition at Noida and the one about Salwa Judam are clearly demonstrative of the concern of the judiciary to uphold the cause of the poor and down trodden. The book discusses the latest judgments of the higher judiciary in the form of case law. Where applicable the expectations of the illustrate, a discussion on the Millennium Development Goals. Various attempts made by the government in the shape of steps for the empowerment and social engineering have also been catalogued.
