Granting of maintenance is a measure of social justice, by itself and it is the fundamental duty of a every man to maintain his wife, children, parents, near relations, etc., so long as they are unable to maintain themselves. In view of Section 3(b) of the Hindu Adoptions and Maintenance Act, 1956, 'maintenance' includes, (i) in all cases, provision for food, clothing, residence, education and medical treatment (ii) and in case of an unmarried daughter, also the reasonable expenses of and incident to her marriage. Maintenance provisions fall within the ambit of Article 15(3) of the Constitution of India
