Description
Apart from a few statutory changes, the progressive development of the subject has taken place largely through the enormous amount of court decisions and also decisions of Accident Claims Tribunal. The largest number of decisions are coming out of consumer Forums and Commission. Consumer complaints under the Consumer Protection Act have become a more attractive opening to consumer suffering from the conduct of mushroom insurers. There is a two-fold primary season for this attraction, namely, no court fee and expeditious disposal. Whatever may be the period of limitation is now applicable to insurance claims. This branch of law being a welfare legislation, its content of welfare cannot be cut down by prescribing a period of limitation.
