Description
As an author I am happy to revise my book "FIR Arrest and Bail" for third time. After third edition in 2014, there are some major developments in the field covered by this book. Recently criminal law was changed in 2018 with reference to increase in punishment for the offence of rape, which includes possibility of imposing even death penalty. 2018 Criminal Law Amendments have brought changes in Protection of Children from Sexual Offences Act (POSCO Act, 2012) besides three major criminal laws-IPC, CrPC and Evidence Act. Those changes are analysed in this book. After the gruesome rape and murder of Nirbhaya in Delhi, there are significant changes in law regarding FIR also. After similar crime on Disha in 2019 in Hyderabad, the Zero FIR came into centre stage of discussion. Refusal to register an FIR on complaint about offences against women is made an offence. Whether registering FIR is mandatory was another question that the Supreme Court was thoroughly engaged in and its final decision in 2014 is a landmark on FIR processes. Separate parts on Zero FIR and Mandatory Registration of FIR are added to the Chapter on FIR.
