Description

This book on the Indian Evidence Act 1872 is intended for students of law, teachers and practising lawyers during my experience as a teacher, I felt the need for a book on evidence for graduate and post-graduate students as well as research scholars and practising lawyers. The work is divided into three parts in eleven chapters and opens with a brief resume which describes jurisprudential, philosophical and legislative basis of the Indian Evidence Act 1872. Chapter 1 deals with the relevancy of facts discussing interpretation clause, "May Presume" and so on. The chapters provide with a historical background to a current statutory framework. Chapter 2 covers "of the relevancy of facts", elucidating relevancy of facts forming part of the same transaction, facts which are the occasion, cause or effect of facts in issue, admissions, statements by persons who cannot be called as witnesses, statements made under special circumstances, judgments when relevant and so on. Chapter 3 deal with facts which need not be prove, Chapter 4 discusses oral evidence. Chapter 7 is on the burden of proof. Estoppel is discussed in Chapter 8. Chapter 9 entitled "of witness" is on the facts of witnesses. Chapter 9 elaborately discusses the examination of witness and the last Chapter i.e., Chapter 11 is on improper admission and rejection of evidence.
