Description
Law of evidence encompasses the rules and legal principles that govern the proof of facts in a legal proceeding. Evidence is known as proof. Evidence simply means anything which is necessary to prove a particular fact. The Indian Evidence Act, originally passed by the Imperial Legislative Council in 1872, during the British Raj: The enactment and adoption of the Indian Evidence Act was a path-breaking judicial measure introduced in India, which changed the entire system of concepts pertaining to admissibility of evidences in the Indian courts of law. The Indian Evidence Act and introduced a standard set of law applicable to all Indians. The law is mainly based upon the firm work by Sir James Fitzjames Stephen, who could be called the founding father of this comprehensive piece of legislation. The student of law has to appreciate the concepts and principles underlying the law of evidence and identify the recognized forms of evidence and its sources. The subject seeks to impart to the student the skills of examination and appreciation of oral and documentary evidence in order to find out the truth. The art of examination and cross-examination, and the shifting nature of burden of proof are crucial topics.
