Description
Let me begin first to express my excitement to have been given the opportunity to work on the third edition of this book. As an academician who is interested and offers papers on consumer laws, the revision work offered to me by the publisher was a perfect chance to be associated with a classic book on the Law of Consumer Protection.
To keep in pace with the changing scenario and the development of the market, to modernise the legislation on consumer protection, it has been felt necessary to replace the existing Consumer Protection Act, 1986 by way of introducing a new legislation. Accordingly, the Consumer Protection Bill, 2015 has been tabled in the Parliament. The New Act proposes to establish an exclusive agency by the name, Central Consumer Protection Authority which will protect and enforce the rights of consumers. The proposed legislation will also contain concretized sections dealing with misleading advertisements, tele-marketing, multi-level marketing, direct selling and e-tailing.
The present edition of this book serves two basic purposes. Firstly, it has been updated to include all the relevant cases since the last edition. Procedural aspects of the law have been given greater focus. This edition includes the latest developments and case law under the Act. Secondly, this edition will also serve as a bridge between the Consumer Protection Act, 1986 and the proposed new legislation. Reference to the Consumer Protection Bill, 2015 at different places will enable the reader to appreciate the proposed legislation with regard to the 1986 Act.
