The new edition presents an orderly and systematic commentary on the subject of growing importance in a simple language and lucid style, the laws relating to transport by road, rail, air and sea (as also the relationship between a carrier and its passengers).
The importance of transport and carriage of passengers is being increasingly recognised as a part of infrastructure industry and as a result a lot of changes are taking place in this field. The book discusses disputes largely relating to loss of or damage to life or property e.g. by explosion, delay in carriage of passengers, modes of compensation, conflict of laws relating to jurisdiction of adjudicating machinery e.g. whether Lok Adalats or Consumer Disputes Redressal Agencies and applicable laws of limitation of actions or whether a pleasure trip by an air balloon is equivalent to a journey by air, etc.
The author has discussed how existing laws have to be developed or expanded by judicial interpretation or supplemented by new enactments to address the disputes arising thus. Further, in the current edition the author has provided the complete text of the Carriers Act, 1865 and also elaborately dealt with consumer cases on services of carriers. In addition to the Indian and English authorities, the author has also taken proper note of the American, European, Malaysian, New Zealand and Australian authorities as well.
