Description
There are several devises by which the disputes between litigants may be settled. Settlement through court is the prime method and is determined under the supreme authority of the State. The other methods are called alternative dispute settlement mechanisms.
One may agree to abide by the decision of some elder members of the family or the community. Here, the settlement decided upon by such elders is respected and documents are accordingly executed as per the terms so as to give effect to the decisions contained in such settlements. The Memorandum prepared by such elders is admissible in the court but it must be proved by tendering oral evidence. It is only then the court will accept the decision contained in the memorandum. Thus, the memorandum by itself is not enforceable through court. That is the reason why in the document of family settlement, the Preamble recites that there have arisen some disputes and the members of the family have accordingly agreed to the terms contained in the document of family settlement, as advised by the elders.
