Description
It seems ages ago when sat down together to finalise the 5th editions of this book. to be precise, seven years have passed. A lot has changed in these seven years—both in the field arbitration and in our lives which has had an impact on this book. Arbitration law has marched along merrily. The law in Bhatia International on applicability of Part I to foreign seated arbitrations now stands overruled by BALCO; the 'arbitrability" test as set out in Booz Allen has given rise to some interesting jurisprudence; Shin-etsu is no longer good law on the scope of Section 45 in light of the decision to Chloro Control; and most importantly the Arbitration and Conciliation (Amendment) Act, 2015 has made redical changes to the existing law. To put it in a nutshell, the sui-generis arbitration regime (as India's regime was in 2010) has slowly moved to wards some sort of orthodoxy by embracing certain universally accepted principles of arbitration law. During this phase, many things have  also changed at our end. We have both moved from clifford Change, London, where we were when the previous edition was released to set up our own practices in India. While the journey has been enjoyable, it has meant busier and more erratic schedules which has consequently led to a delay in the release of this edition. Our personal lives have also had an impact on the timeline. Illustratively, the winter break of 2015 was to be dedicated towards sitting down and penning down our commentary on the 2015 Amendments, which had just come out on 23 October 2015. One day afer one of us (Anirudh Wadhw) landed in Bengaluru for this purpose, the other's (Anirudh Krishnan's) son (Adrith) was born, one moth early, further pushing our schedule!
