Description
At the outset, I would like to express my sincere thanks to all the readers for their overwhelming response to the first edition of my book on 'Law of Arbitration and Conciliation in India' which was published in the year 2016. Delays and arrears in the justice delivery system in India are age-old problems causing frustration to the litigants in their long wait for justice. Several Committees have been appointed by the Government to examine the causes of these delays and arrears and give their recommendations to mitigate the problem. As part of the measures taken to reduce delays, the Government introduced major reforms by way of amendments to the Civil Procedure Code, 1908 in the year 1999 and 2002 by specifying time frames for procedural steps in civil proceedings. Despite the measures taken by the Government, the pendency of cases in courts remains alarmingly high. It is estimated that there are more than 3 crore cases pending in the Supreme Court, the High Courts, and the lower courts as on date. While the Judges have been making their sincere efforts to clear the backlog of cases, fresh cases filed in courts are outpacing the number of disposals thereby increasing the burden on courts. Thus, there appears to be no early solution in sight to the problem of delays in courts.
