Description

Industrial jurisprudence in India was available in its rudimentary form before independence. Industrial revolution led to the growth of industrial jurisprudence. It is also a fact that industrial revolution brought with it the most inhumane aspect of the human life. It is pertinent to mention here that the scope of industrial jurisprudence is not only restricted up to the protection of the interests of the employees but it also aims at securing a cordial relationship between the employers and the employees. Prior to the independence, the primary concern of the Government was to ameliorate the conditions of the factory workers. But after the commencement of the Constitution, the primary concern of the Government shifted towards social justice for the workers who constituted the bulk of the population. It is both economic and social justice which we cherish in our Constitution. Therefore, the minimum that we must secure to our people is freedom from want and security against economic fear. The importance of social security and economic, social and cultural rights indispensable for the dignity and free development of personality of every member of the society has been recognised by the Universal Declaration of Human Rights.
