It is not a coincidence that the fourth edition of the Introduction to Industrial and Labour Lows has been put up for publication when a lot of debate about Labour reforms is going on in the country and amendments have been made in few labour laws. I am happy to share with you that the book has been updated with all amendments made till August 2016 and the case law till the book went for printing. The book has provided comprehensive knowledge of all major Industrial and Labour Laws since the first edition in 2002. In this edition, Part XVIII providing an overview of the Industries (Development and Regulation) Act, 1951, the Mines Act. 1952, the Collection of Statistics Act, 2008 and the Labour Laws (Exemption from furnishing returns and maintaining registers by certain establishments) Act, 1988 has also been added. Let us first discuss about some of the important decisions that have been made after the third edition of the book. Under the Industrial Disputes Act, 1947, the Supreme Court had the opportunity to decide about who is an employer, an employee and a workman in different employments. The Supreme Court in Ahmedabad Municipal Corporation v. Rajubhai Somabhai Bharwad, held that village panchayat is the employer of persons in service of the Gram panchayat and not the Sarpanch. In ESI Corporation's Medical Officers Assn v. ESI Corporation, the Supreme Court held that medical doctors discharging functions of medical officers were not workmen.
