Description
Since the publication of the last edition significant legislative changes have been brought in the various personal laws applicable to members of all communities in India. As is well known, divorce laws have undergone lot of liberation over the years to meet the demands of changing times. One of the grounds for matrimonial relief has since long been leprosy of the non applicant. however, with advancement in medical science, the disease is no longer incurable, hence the law has been amended and this ground has been removed vide Marriage Laws Amendment Act 2019. Another judicial development of significance during the interregnum is the challenge to relief of restitution of conjugal rights. With movements for liberation of women and demands for gender equality and protection o privacy and liberty, a petition for restitution is being perceived as violative of right to privacy, dignity and autonomy. A PIL challenginf the same has been refered to a three hujdge Bench of the Supreme Court of India.
