Description
This book "A Study on K.S.R. Part III - Pension" is the Eleventh Edition. The Tenth Edition was published in June 2018 incorporating Amendments, Orders and Case Laws up to 30-04-2018. It is a matter of satisfaction that the previous Edition of the publication received wide acceptance from Hon'ble Courts, Government Employees, Service Associations and Lawyers. Government have approved our  publication titled as "A Handbook on Kerala State & Subordinate Services Rules, 1958" & "A Handbook on Kerala Civil Services  (Classification, Control & Appeal) Rules, 1960" as a reference books for all Government Departments vide G.O.(Rt.)385/2011/P&ARD. dated 02-12-2011 & G.O.(Rt.)300/2012/P&ARD. dated 14-08-2012) Pension ensures a social security for those who served arduously during their youth and are relegated to the back ground due to age. It also provides some security to those who are incapacitated  prematurely. Though Pension was initially regarded as a social benefit measure, the statutory entitlement was rightly declared as  property by the Supreme Court in cases resting with D. S. Nakara vs. Union of India AIR 1983 SC 130. As early as 1974, the Kerala High Court had held that right to Pension is right to property including right under Article 300A of the Constitution of India and deprivation will be violative of Article 19 of Constitution of India. For delay in disbursement, in several cases based on the extent of each, penal interest for the period of delay was also awarded by the Hon'ble High Court.
