Description
The Court-Fees Act is not a substantive law as it does not create any rights or liabilities. At the same time it cannot also be termed as procedural law as an amendment thereof does alter the measures the Court takes. However this particular Statute is more inclined towards the procedural side as it ordains that the litigant should pay a fee before Court looks into the particular grievance. This implies the fact that in case of uncertainty it should be interpreted in favour of the citizen and unless retrospective effect is expressly intended by the Legislature, no extra burden should be placed on him over and above what he could anticipate before commencing litigation. Thus I can say that Court-Fees and Suits Valuation Act is indeed an important piece of legislation which facilitates and in a way regulates the filing of cases in Courts of various jurisdictions in our State apart from generating reasonable amount of revenue to the Government.
Latest provisions with regard to Legal Benefit Fund are included in this book. I have included the amendments made in 2016.
