Description
Interpretation of statutes is related to understanding or explaining the provisions of law. Interpretation is the key to unlock the meaning of the provisions of a Statute. The will of the legislature is expressed generally in the form of a Statute. The Court brings out the true intention of the legislature expressed in the Statutes. Thus the primary role of judiciary is to interpret the laws made by the lawmakers. Among the three wings of the Government, the Legislature makes law, the Executive implements the law and the Judiciary interprets the law. The object of interpretation is to bring out the true intention of the legislature. The proper interpretation ensures just and fair action while taking decisions. The Court while interpreting the Statutes has to apply the general principles of interpretation. In their attempt to make the old and existing statutes contextually relevant, courts used to develop certain rules, doctrines and principles of interpretation. Judiciary plays a highly creative role in this respect. What are the techniques adopted by courts in construing statutes? How far are they successful in their strategy? The student of law is expected to have thorough knowledge about the principles of interpretation.
