Description
Interpretation of Statutes by B. M. Gandhi is greatly admired and read by students, lawyers and judges. Interpretation of Statutes is the branch of law that deals with the process by which courts interpret and apply legislation. This new second edition is divided into 14 chapters. The "Introduction", among other things deals with the meaning of a statute, kinds of statutes and role of judges in interpretation. Chapter? deals with the basic rules of interpretation, while Chapter 3 deals with the subsidiary rules of interpretation. There are certain aids which assist in the process of interpretation of statutes. These aids are of two types: internal aids and external aids (dealt with in chapters 4 and 5, respectively). Chapter 6 deals with certain presumptions which have to be kept in mind while interpreting statutes. The scope of operation of statutes is discussed in Chapter 7. Chapters 8 and 9 deal with statutes affecting the State and Court's Jurisdiction respectively. Chapters 10, 11 and 12 deal with the repeal and expiry of statutes, taxing statutes, and penal and remedial statutes. Chapters 13 and 14 deal with delegated legislation and interpretation of the Constitution of India. The book has been written with the object of acquainting the students, teachers, drafters, lawyers, judges and other persons interested in this field with the various principles of interpretation. The book covers the latest case laws of the Supreme Court and the High Courts. This second edition will certainly prove to be useful for the students, teachers, drafters, lawyers and judges.
