Description
International humanitarian law (hereafter, IHL) is the branch of international law that applies at the time of war. It relates to the humanitarian concern and is an effective instrument that the international community has at its disposal to ensure the safety and dignity of people during wartime. IHL has made a difference in protecting civilians, prisoners, the sick and the wounded, and in restricting the use of barbaric weapons such as nuclear weapons, biological weapons, and other toxic weapons. Given that this body of law applies during times of extreme violence, implementing the law will always be a matter of great difficulty. The international refugee law, on the other hand, encompasses a set of rules established by treaties or customs with the aim to assist the individuals who have crossed an international border and are at risk or are victims of persecution in their country of origin. Refugees are among the most vulnerable people in the world. There are several types of forcibly displaced persons like refugees, asylum seekers, internally displaced persons, stateless persons, returnees. Millions of stateless people have been denied a nationality and lack access to basic rights such as education, health care, employment, and freedom of movement. Both international refugee law and IHL originated in the need to address the protection of persons in the hands of a State of which they are not nationals. The present book covers both these branches of international
law.
