Description
Intellectual property rights are like any other property rights. These rights allow the creator, or owner, of a patent, trademark, or copyright to benefit from his or her own work or investment. These legal rights result from intellectual activity in the industrial, scientific, literary or artistic fields. The recognition and protection of these rights is of recent origin. IP shall include the rights relating to Literary, artistic and scientific works, Performances of performing artists, phonograms and broadcasts, Inventions in all fields of human endeavour, scientific discoveries, Industrial designs, Trademarks, service marks and commercial names and designations and Protection against unfair competition. The object of intellectual property law is to exclude third parties from exploiting protected subject matter without express permission or authorization of the right holder, for certain duration of time. Intellectual property laws provide owners with the power to enforce their property rights in Civil Court. They provide for damages when unauthorized use or misuse has occurred. They also provide for injunctions, or Court orders, to prevent unauthorized use or misuse. Thus the sudy of various aspects of IPR is essential for a law student.
