Description
I am delighted to offer to the readers the second edition of t book. The process of explaining the legal concepts with the help judicial
pronouncements continues. The structure, by and large remains untouched. On few occasions, the headings have be altered and overall the text has become more reader-friendly. Inclusion of recent judgments delivered by the Supreme Co of India and various High Courts in India, dealing with the topic the highlighting feature of the second edition. It addresses important and relevant jurisprudence
developments in the area concern that have taken place since the publication of the first edition. For example, in Toyota Jidosha Kabushiki Kaisha v Prius A Industries Ltd. and Ors., the Supreme Court of India held that in action against passing-off, the plaintiff must establish that goodwill exists in India; goodwill located outside India cannot h the plaintiff to maintain passing-off action in India. The Delhi H Court in the Chancellor, Masters & Scholars of the University of Oxf and Ors. v Rameshwari Photocopy Services and Ors. (DU Photocopy case) held that making of a master photo copy of 'course pac (compilation of photocopies consisting of portion from bo included in syllabus in which the copyright exists) and fury facilitating distribution of photocopies of the same amongst students at nominal rate by an educational
institution is permit
under section 52(1)(i) of the Copyright Act, 1957.
