Dr. V.N. Tripathi's Commentary on The Indian Succession Act, 1925 needs no introduction to our learned readers/patrons since it has held the field from 2004 and now it has entered in its Fourth revised and enlarged edition.
The Act has been divided into eleven parts. Parts V, VI and IX have further been divided into several Chapters. Parts II, IV and V do not apply to Hindu, Mohammedan, Buddhist, Sikh or Jain communities and Part VI in general, does not apply to Mohammedan and Hindu etc. But some of its provisions are applicable to Hindus.
Succession is a transmission of rights and obligations of a deceased to his heirs and it includes both intestate and testamentary succession. The major part of the Indian Succession Act is based on English Law, but the Indian Judiciary and even the Privy Council have given frequent warning against the application of English rules of law to the construction of Wills in India because conditions of life and considerations of people of India are different. Keeping in mind this position, the emphasis on English decisions has not been given in this book.
Due to overwhelming demand of a latest book on such laws, and also because it was high time to revise the book, the author spared no. pains to accomplish the renewal of the existing book in the light of the latest case law(s), amendments and orders/decisions of the various High Courts and the Supreme Court of India. The outcome of the onerous task of updating the book is thus the Fourth Edition of the Indian Succession Act in the latest form to serve the present day requirement of the Bar, Bench, litigant public and other esteemed readers.
