Description
Originally published in 1891, Hudson was the first, and for many years the only authoritative work on the law relating to building and engineering contracts, From 1959 to 2004, under the editorship of lan Duncan Wallace OC, it acquired a distinctive voice, based on the editor's views, often trenchantly expressed, as to the correctness of the developing jurisprudence in the UK. We have retained and added to the material which contrasts the UK approach with the appronch in other common law jurisdictions. We have retained and developed material which deals with matters not dealt with elsewhere. But we have undertaken considerable remodelling of each chapter to make it more accessible, and to reflect the changing importance of different topics. This edition has retained the same structure as the 13th edition, but three chapters have been rewritten. The text on insurance, indemnities, and guarantees in Ch.10 has been rewritten, as has the text on assignment and subcontracts in Ch.9. Chapter 3 has been rearranged and the approach to contractor's obligations and tender obligations simplified to some extent. This edition also contains considerable changes in relation to limitation, misrepresentation, mistake, consumer rights, statutory restraint on unfair terms, and other general topics summarised in Ch.1. Since the last edition there have been several cases which hinted at changes in the law, but for the moment the law remains unchanged. Thus it is not clear whether the changes to the law on penalties in Makdessi will be pursued further, although in general the case has been well received in other jurisdictions, Similarly, it is not clear if the case of North Midland v Cyden Homes signals a new approach to the law relating to acts of prevention. This edition addresses prevention at greater length than before in Ch.3. It is possible that MWB Business Exchange Centres Ltd v Rock Advertising Lid might disrupt the merits driven approach adopted towards formal requirements in contracts. However, it is too early to identify whether it has done so.
