Description
The Eleventh Edition of Gopalakrishnan Law of Walls is before the readers. The subject has always remained important for civil law practitioners and the law on the subject continues to evolve with time. While updating the case-law on the subject, we have made sure that the principles already settled are not repeated in the text of the book. In the Tenth Edition, there were 87 Chapters in the book. They seemed to be too many in number. We have merged the contents of Chapters which were covering the same subject for our readers' convenience. The number of Chapters are now reduced to 53. This exercise of reducing the number of Chapters by merging the contents of related topics would help in locating with ease the relevant contents which were spread out in different Chapters are different parts of the book in the previous editions of the book. Notable developments on the subject are two judgments of the Supreme Court. One is Lynette Fernandes v Gertie Mathias,' whereby the Limitation Act has been made applicable to an application seeking revocation of grant of probate and it has been held that Article137 of Limitation Act will apply to such cases. Second, in Vinedohvandru Sakarlal Kapadia » State of Gujarat, the Supreme Court has held that testamentary disposition of agricultural land to a non-agriculturist is against the Bombay Tenancy and Agricultural lands Act, 1948.
