Description
The fourth edition continues the work started by the first in 1999 of integrating the principles to be found within the general body of English law into English carriage of goods and international trade law so as to demonstrate how the general principles affect the specific and vice versa. The aim is to offer not only a practical source book and vade mecum for practitioners but also a work of more general interest to others. Naturally many new cases have fallen to be incorporated since the last edition, though a great deal is often still to be gained from a close consideration of the basic principles so precisely and clearly elaborated in many instances in the older primary source authorities and by nineteenth century English, and especially American, scholars. The coverage of relevant material is, the authors hope, as comprehensive as is feasible within the limitations of space encountered by any one volume work of this type but, in seeking to achieve this end, the authors trust their approach is not to be likened to that of the undiscriminating advocate. The general order of presentation of the material remains the same as in the previous, third, edition, save that the opportunity has been taken in this edition to somewhat re-arrange the order of the material in damages to be found in chapters 13 and 14. Other chapters have been more or less substantially rewritten as required by recent authority or further reflection on the part of the authors. find The Appendices to this fourth edition incorporate only those international transport conventions which form part of the laws of the United Kingdom. For the texts of other international conventions, purely domestic legislation and typical form contracts as found in the appendices to earlier editions, we refer the reader to the internet where these materials can now be readily found.
