Description
This edition of the Tagore Law Lecture on the law relating to Easements in British India by the Tagore Law Professor Frederick Peacock is different from other editions after the demise of the author. In this edition the original text of the lectures on the subject has been retained in tact so that the readers can appreciate the impact and importance of those lectures. The contemporary and modern developments of law in this field have been added at the end of relevant chapters of this edition.
The Indian Easements Act, 1882 is as old as the Transfer of Property Act, 1882; but the important difference between these two Acts is that the Transfer of Property Act, 1882 extends to the whole of India except certain parts thereof where applicability of this Act is given by notification in the Official Gazette of State concerned, whereas the Indian Easements Act, 1882 extends to seven States of India till the present time. Such non-applicability of the Indian Easements Act, 1882 to the rest of the Indian territories has enhanced the importance and impact of these Tagore Law Lectures for applying the principles laid down therein on different issues and problems.
Thus, it is hoped that this valuable classicial work on the law of easements should be much beneficial to one and all who are interested in this special branch of jurisprudence.
