Description
Family law-ll deals with the Hindu Succession Act, 1956, Mohemmadan Succession Law, The Indian Succession Act, 1925 and the Indian Trusts Act, 1882. These enactments have been made to regulate rules of succession and inheritance to the property. The Hindu Succession Act, 1956 is an Act of the Parliament of India enacted to amend and codify the law relating to intestate or unwilled succession, among Hindus. The Hindu Succession (Amendment) Act, 2005, amended Section 6 of the Act, 1956, allowing daughters of the deceased equal rights with sons. In the case of coparcenary property, or a case in which two people inherit property equally between them, the daughter and son are subject to the same liabilities and disabilities. The amendment essentially furthers equal rights between males and females in the legal system. The Muslim law of succession has been derived from the rules found in the Quran. The Indian Succession Act, 1925 is passed by the Parliament to consolidate the law applicable to intestate and testamentary succession. The Indian Trusts Act 1882 is a codification of trusts law, introduced for India in 1882. Hence the student of law must have a clear insight in the various personal laws relating to succession, inheritance to property.
