Description
Much has changed in the five years since the publication of the third edition. In 2011 the Supreme Court swept away the immunity of experts from suit by the party instructing them: Jones v Kaney [2011] UKSC 13; [2011] 2 A.C. 398. This has led to a complete re-write of Chapter 14. In the same year the Law Commission published its report (No. 325) "Expert Evidence in Criminal Proceedings in England and Wales" Its principal recommendation was that the admissibility of expert opinion evidence in criminal courts should be placed on a statutory footing and that it should be admissible"only if it is sufficiently reliable to be admitted". This was to mean that expert opinion must be "soundly based" and that 'the strength of the opinion is warranted having regarded to the grounds on which it is based. The Law Commission proposed that the courts should follow a statutory checklist when assessing the reliability of expert opinion evidence.
