Environmental law is meant to protect and improve the quality of environment. It is a basic right of every person to live in a healthy environment. Prevention and control of pollution through law legislative measures and implementing agencies gives us better environment. According to Tiwari Committee, there are nearly five hundred environmental laws in India. Every enactment relating to promotion and protection of environment is enacted to regulate human conduct so as to control environmental pollution. Very strict procedure and liabilities are provided for the effective implementation of environmental laws. The controlling agencies established at various levels under environmental laws tries to controls the pollution in their own way. Thus environmental law may be considered as a branch of public law and also a branch of private law. The aggrieved person may bring civil action to compensate the loss suffered due to pollution. Damages and injunction are the two civil remedies apart from the criminal action. A claim for unliquidated damages is the primary remedy under law of torts. Thus environmental law may also be considered as a branch of private law. Hence the study of the environmental law is essential to the students of law.
