Description
It is trite to say that electricity has become an indispensable necessity for life in the home, office and in all educational, industrial, commercial and social organisations. Courts have held that electricity has to be provided as a part of shelter to a person who so requires it. Along with the growth and development of society and of industry and trade the electrical industry has also been an essential concomitant as necessary infrastructure. Accordingly, legislation governing the industry, supply and use of electricity has evolved. Initially the law catered to the needs of safety in the generation distribution and use of the energy, as the basic feature of the Electricity Act, 1910. Subsequently with the growth of the industry and needs of society the span of social or state regulation of the industry increased with experience keeping in view aspects of public interest, the efficient, generation, transmission and distribution of electricity. Thus the Electricity (Supply) Act, 1948 was passed and subsequently the Indian Electricity Rules, 1956 formulated, followed much later by the Electricity Regulatory Commissions Act, 1998.
