The electronic commerce market has shown a phenomenal upward growth trajectory in recent years and is bound to grow further with the rise in internet penetration. The ubiquitous reach and the ease of access to a wide variety of goods and services are the major drivers of electronic commerce, making it an important channel for trade, no industry can ignore. At the same time, with the rapid development of technology, it cannot be denied that it often outruns the law. The debate whether or not India is sufficiently equipped with a legal framework to govern this large booming electronic commerce market has continued for long. During the course of my research on Electronic Commerce and Law at the National Law School of India University, I had an opportunity to study laws directly or indirectly governing the electronic commerce market. This brought a revelation that though there is no specific law on electronic commerce in India, mandatory requirements for disclosures, compliance and due diligence have been provided for under various legislations, including sector-specific regulations. As a legal professional, and more importantly, an ardent online shopper, I felt the need for adequate disclosure of information at every stage of an online transaction, given that the architecture of electronic commerce is completely virtual. The only way an electronic commerce entity can build trust and confidence in its business is to provide the end user with sufficient information.
