Description
The Indian Contract Act 1872 was passed to define and amend certain existing laws relating to contract in India. The Act is not exhaustive though it repeals the provisions of the Royal Charters of 1753 and 1774 in this regard. Elements of contracts are there in the Transfer of Property Act 1882, Negotiable Instruments Act 1881 and the Indian Railways Act 1890 besides those which were expressly repealed as in the Schedule. The personal laws of the Hindus and the Muslim are also applicable in some matters. All these factors make indispensable all the judicial pronouncements carved out as having legal consequences. But so far as it goes the law on contracts is exhaustive and imperative.
Jurisdictional issues
In this era of globalisation, trade and commerce extend beyond the boundaries of the nation in the form of exports and imports. The compulsions of globalisation and India being a member of the WTO the above are playing a vital role in Indian economy. The importance of this branch of law needs no emphasis. Keeping in view all these aspects, this edition has been revised thoroughly. While travelling through the subject every corner of it was touched. Almost all the problems are discussed to acquaint the readers with the development on the subject, such as—del credere agent, champertous agreement, void agreement, breach of contract, building contract, software agreement, outsourcing agreement, consultancy agreement and so on.
