Description
This edition has been thoroughly revised with the inclusion of numerous cases. Over the years, the Supreme Court of India has been enlarging the scope of service jurisprudence. The Court has placed suspension at par with criminal proceedings. It has been observed that when a charge is not framed for ninety days in a criminal case, the accused gets benefit of bail, accordingly, similar relief should be granted to a person who is under suspension and against whom no charge sheet has been framed.' Proviso to Article 311 (2) was revisited by the Supreme Court of India in a jail break case from Burail Jail in the Union Territory of Chandigarh. A tunnel was dug and the under trials escaped. The dismissal of the jail staff after dispensing with holding of an inquiry was upheld.2
I have also incorporated judgments from the United Kingdom. These judgments deal with the concept of equal pay for equal work.3 Again in one of the judgments while interpreting statute, an interpretation was given which was in line with the laws of European Union, even though there was no express provision to that effect in the Statute under consideration.4
