Description
It is trite to say that Labour and Employment Laws are sui generis in the area of legal practice; being majorly judge-made they perfectly embody the adage of 'change is the only constant. The fitful nature of the functioning of industries and employer-employee relations over the decades has indeed been reflected in the mindset of judges and inter alia in the kind of judgments pronounced by them. In the initial years of industrial adjudication, it was not uncommon to see every other workman being awarded reinstatement with full back wages over the non-compliance with the provisions of section 25F of the Industrial Disputes Act, 1947 by the management. However, with the passage of time, it has been seen that judges now prefer to award compensation instead of reinstatement with back wages. It certainly shows that the trend has indeed changed.
This is further accentuated by the fact that earlier while the presence/absence of Mens RealActus Reus used to be a significant factor in determining the liability of employers under section 14B of the Employees' Provident Funds & Miscellaneous Provisions Act, 1952 today, by virtue of the judgment of Horticulture Experiment Station Gonikoppal, Coorg v. The RPFC, 2022 LLR 698, the former has been rendered a mere speck of dust in PF adjudication. This digest aims to track and consolidate within the precincts of its covers this very wavering history of industrial jurisprudence.
