Description
This book has been created due to the recent increase in demand for stand-alone cyber risks insurance and reinsurance coverage. This has been driven primarily by the implementation of the General Data Protection Regulation (EU) 2016/679 ("GDPR") in the EU, along with the Data Protection Act 2018 in the UK. Meanwhile, globally bolstering demand, there has been a series of well-publicised private data and network security breach incidents over the past few years. In response, the insurance market has enhanced its offer of stand-alone cyber insurance policies, the "affirmative" cyber risks coverage, both as regards the number of new insurance companies entering the market and the broader scope of coverage now being offered. In parallel to this growth in demand for affirmative stand-alone cyber policies, the need for this book has been highlighted by the intervention of the Prudential Regulation Authority ("PRA") in the UK which has become more pressing since 2017. The PRA has voiced its serious concerns regarding the "non-affirmative" or "silent" cyber risks coverage which may be incidentally offered by the traditional lines in the insurance market. These concerns have been caused by the often unaccounted for non-affirmative cyber risks exposure of insurers and reinsurers in traditional lines, which have relied on outmoded exclusionary language that is unfit to handle the diversity of evolving cyber risks.
