Description
If you are to punish a man retributively, you must injure him. If you are to reform him, you must improve him. And men are not improved by injuries.—Justice Krishna Iyer 'perspectives in criminology, Law and Social Change'. The present Edition is vastly revised. Four new chapters are added. These are from chapters 18 to 21. Chapter 18 is titled "Combating of Cyber Crime". Information Technology Act, 2000 has been drastically amended by I.T. (Amendment) Act, 2008. Some new sections are added in view of the facts that cyber crime is posing threats to the internal and external security and hampering economic development and growth, among others. These amended provisions are inserted in the said chapter which have a potential impact on combating cyber crime. The next chapter deals with "Alcohol & Drug Abuse". This is chapter 19. Alcohol & Drug Abuse are spreading like a wild fire. The constitutional provisions including Article 47 and other Acts, are enacted to control this menace. This is discussed widely in this chapter. Chapter 20 deals with "Victimology Compensation and Restitution" Victimology is a sister science of criminology. It has been ignored to a greater extent by our criminal courts. A new section 357-A has been inserted in the Code of Criminal Procedure (Amendment) Act, 2008, in this respect. However, this amendment has not come in operation so far. In this chapter a detailed discussion is undertaken on all aspects of compensation and restitution to victims of crime. Next chapter is related to "Protection of Rights of Women And Marginalized". This is the last chapter of the revised Edition. The discussion on various newly enacted laws is critically made in this Edition. The Domestic Violence Act, 2005, Surrogacy and Prohibition of Sex Selection Act, 1994, amended in 2003, among others, are analyzed in detail.
