Description
Legal procedures provided for the administration of justice occupy a predominant place in the modern civilized legal world. Effective procedural law helps in regulating the rule of law and maintaining peace and security of the people living in any given country. In India, the Code of Criminal Procedure, 1973 (for short, hereinafter referred to as "the Cr.P.C."), is the primary law contemplating procedure to deal with and dispose of criminal cases starting from receiving of complaints of victims of offences and ending with trial and finally disposal of cases including certain post-convictional measures. The scope and application of the Cr.P.C, extends to offences falling not only under the Indian Penal Code, 1860 but also under other special or local laws,in so far as the same do not exclude its application in any given case. The Cr.P.C. though a procedural law, in fact, is also a substantive law. It contains procedural provisions for the prevention, control, regulation and rehabilitation of crimes and criminals, as the case may be. It is a Central Law and can be amended by States and Union Territories.
