Description
Business organisations and entrepreneurs frequently enter into agreements to regulate production, marketing, sale and purchase of goods and commodities and maintain prices and standards in their transactions. They also need to enter agency relations and form partnerships for the smooth conduct of their business. There are various laws regulating conduct of business and commercial activities. While the law of contract embodies the underlying concepts and general principles covering day-to-day business transactions, there are other specific contractual laws and statutory legislations which deal with particular kinds of transactions such as sale of goods, partnership, specific relief, negotiable instruments, arbitration etc. The present book mainly focuses on laws relating to specific contracts and allied subjects, namely, Sale of Goods and Partnership, which, prior to 1930s were an integral component of the Indian Contract Act, 1872, but were carved out as separate enactments in the form of the Sale of Goods Act, 1930, and the Indian Partnership Act, 1932. The book comprises three parts. Part I deals with specific contracts including indemnity, bailment, pledge, agency and so on whereas Part II is devoted to Sale of Goods Act. Part III of the book embodies law relating to partnerships in India. The author has endeavored to take note of the developing trends in the business and commercial sectors and their impact on law relating to specific
contracts, sale of goods and partnership. An attempt has been made to deal with these laws with greater thrust on Indian perspective duly supported by relevant case law to explain the legal implications and judicial interpretation thereof. While several cases have been cited with brief reference, the landmark judgments both Indian and foreign, have been discussed in detail.
