Description
The problems of manipulative trade practices such as hoarding, monopolies, misrepresenting quality, quantity, purity etc. of commodities and excessive pricing and profiteering are not the product of modern era but they are prevailing ever since the emergence of trade itself. Society's aversion to these mal practices may be traced far back during the ancient Hindu period when Manu, the father of Hindu Law' described trading as a mixture of truth and falsehood'. Kautilya in his 'Arthashastra' also referred to the exploitation of helpless consumers by unscrupulous traders and need for strict regulatory measures for redressal of consumer's grievances, Though strenuous efforts have been made to restrain trading community from indulging in unfair trade practices by introducing laws for regulation of price and profit but the problem has been escalating due to growth and modernisation of trade and commerce in recent times. It was after the Independence of India that vigorous legislative measures were initiated to curb the unlawful trade practices by enacting laws such as MRTP Act, 1969, which was later repealed and substituted by the Competition Act, 2002. As the MRTP Act was found to have only a limited scope and many anti-consumer activities were still left outside the purview of this legislation, a new Act called the Consumer Protection Act was enacted in 1986 for speedy redressal by consumer's grievances and providing them relief against unscrupulous sellers and renders of commercial services. The Act was amended in 1993 and again in 2002 with a view of extending its scope and applicability,
