Description
The problems of manipulative trade practices such as hoarding, monopolies misrepresenting quantity, quality and purity etc. of commodities are not the product of modern era rather existing since the emergence of the trade itsell. Though sincere efforts have already been made to restrain trading communities from indulging in unfair trade practices by legislating The Consumer Protection Act, 1986. But the consumer market for goods and services have undergone drastic changes since the enactment of the aforementioned Act. The rise in international trade and the rapid development of e-commerce have ed to a new delivery system for goods and services and, at the same time, has rendered the consumer vulnerable to new forms of unfair trade and unethical business practices as well. To curb out these new emerging problems, The Consumer Protection Act, 2019 has been enacted. This Act provides for the establishment of Central Consumer Protection Authority' (CCPA) to promote, protect and enforce the rights of consumers and Mediation' as an alternative dispute resolution mechanism. It also provides for several provisions aimed at simplifying the consumer disputes as : enhancing the pecuniary jurisdiction of the Consumer Dispute Redressal Agencies; increasing minimum numbers of members in the State Consumer Dispute Redressal  commission and filing of complaints electronically etc. Another main feature of the Act of 2019 is to provide for product liability action against product manufacturer or a product service provider or a product seller, as the case may be for any damage caused to him on amount of a defective product.
