Description
Consumer protection had been an issue of concern even during ancient India, and in the contemporary era it has gained momentum globally, given the advancement of technology, leading to the necessity of aggressive awareness of the various facets of rights of consumer.Prior to the enactment of The Consumer Protection Act, 1986, some of the statutes in prevalence containing protection to consumers to a limited extent are: The Indian Penal Code, 1860; The Indian Contract Act, 1872; The Usurious Loan Act, 1918; The Agriculture Procedure (Grading and Marketing) Act, 1937; The Sale of Goods Act, 1930; The Drugs and Cosmetics Act, 1940; The Prevention of Food Adulteration Act, 1954; and The Monopolies and Restrictive Trade Practices Act, 1969; which were inadequate in providing protection to the rights and interests of consumers. The Consumer Protection Act, 1986, was enacted to provide for better protection of the interests of the consumers and for that purpose to make provision for the establishment of consumer councils and other authorities for the settlement of consumers' disputes and for matters connected therewith, which was followed by framing of Rules and Regulations thereunder. The modes of, selling and buying of goods and rendering of services witnessed a paradigm shift, given the advent of online platforms, in pursuance whereof, certain provisions of The Consumer Protection Act, 1986, proved inadequate, prompting the necessity of enactment of The Consumer Protection Act, 2019, and framing of The Rules and Regulations thereunder.
