Description
As I put pen to paper, it is difficult to ignore the swirling debates
that envelope the national narrative today. The law is front and centre,
with the bail denial of a 23-year old in our commercial capital, the
horrors of a murderous convoy in our largest district, the arrest of
cricket fans in our most populous State and the use of malware to hack
our citizenry jostling for the headlines. What these four incidents have
in common (apart from the obvious role of our political class) is the
most important right enshrined in our Constitution Article 21. It is
difficult to conceive how a provision that has been enriched and
enlarged to encompass the most cherished values of the Indian people has
been ignored with such impunity over so many years. For those who
encounter the Constitution for the first time, it appears to contain a
set of ideals, some Utopian, some esoteric, and all seemingly divorced
from any practical application. Unfortunately, the manner in which this
branch of law (it is actually the very trunk, far from being a branch!)
is taught in institutions across the country makes the entire discipline
seem too dense even for the most earnest of students. It is this
fogginess that is then carried with them into the practice, where even
the most rudimentary elements of due process are abandoned.
