Description
The last five years have been phenomenal, not only because the number of internet users in the world reached 4.66 billion but because the Covid pandemic spurred stupendous growth in the IT sector in a totally unprecedented way. While concepts of Blockchain, Artificial Intelligence, Fake News and Right to be Forgotten emerged into prominence, New Laws, Rules, Policies and Cases helped shape Cyber Law in the country. The third edition of this book discusses the GDPR Regulations in Europe, and developments in Indian law, including the Personal Data Protection Bill, 2019, the Consumer Protection Act, 2019 and Telecom Commercial Communications Customer Preference Regulations, 2018. The third edition of the book also discusses the landmark case of Retd Justice KS Puttaswamy v UOI wherein the 9 Judge Bench of Supreme court of India expressly held the Right to Privacy is a fundamental right. The landmark cases of Anvar v Basheer and Shafhi Mohammad v State of HP and the recent judgment in the Arjun Pandit Rao v Kailash Kushanrao Gorantyal are discussed which explain the manner in which electronic evidence is required to be produced before a court of law to be admissible. The New Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 are also discussed which elucidate the due diligence required of online publishers of content such as online news portals and broadcasting companies. These developments have constructively reshaped the contours of evolving Cyberlaw in India. I am most grateful to the Almighty who gave us the strength, courage and determination to overcome the unforseen challenges of the Pandemic and emerge stronger and resilient in these unprecedented times. I am deeply indebted to Hon'ble Dr Justice DY Chandrachud for sparing his valuable time from his busy schedule to write the Foreword for the third edition of this book. I had opportunity of presenting him personally the first Edition of this book in 2013 when I had conducted Cyberlaws Trainings for District Judges at the Maharashtra Judicial Academy. It is both a great honour and privilege to receive the Foreword from Hon'ble Dr Justice Chandrachud whose knowledge in cyberlaws is unparalleled and who is also the Chairperson of the E-Committee of the Supreme Court of India.

Author Details
Karnika Seth specialises in cyber law and intellectual property, and is Managing Partner of Seth Associates, an internationally networked full service Indian law firm. Ms Seth is also the Chairperson and Founder of Cyberlaws Consulting Centre at Seth Associates, the world's first integrated cyberlaws research, forensics and legal consulting centre. She has significant and diverse transactional experience encompassing internet and e-commerce laws, business laws, international trade and intellectual property laws and is principal legal advisor to many multinational groups, corporate houses, public and private sector companies, corporations and government entities. She has actively resolved many cybercrime cases in conjunction with the Cyber Crime Cell, Delhi, and Economic Offences Wing of the Delhi Police and other law enforcement agencies in India. Karnika Seth graduated in Law from the Campus Law Centre, University of Delhi. She studied Cyberlaws at the Amity Law School. Delhi in the year 2000 and received her Masters degree in Law in Corporate and Commercial laws, Intellectual property, internet laws. International Trade and Arbitration from the King's College, University of London in the year 2002. She is also an Associate Member of AEA International, the International Association of European lawyers and is an active Member o! the International Bar Association. Bar Council of Delhi, India, the Supreme Court of India Bar Association, Delhi High Court Bar Association, the Indo-ltalian Chamber of Commerce and Industry and the Indian Council of Arbitration. Ms Seth has authored articles and reviewed books on various legal issues on information technology and business laws for several reputed publications, such as Patent and Trademark Reporter. Halsbury's Law Journal. Indian Council of Arbitration Journal, Cyber times newspaper, and online information portals such as tradeindia.com and stands appointed to the International Editorial Advisory Board of the International Journal of Cybercrimes and Criminal Justice. She is an active Speaker on Cyberlaw issues in conferences organised by FICCI, ASSOCHAM, PHD Chambers and other leading institutions of the country and in various cyberlaw discussions held on television. She delivers special workshops on information technology law and practice to honorable Judges from the Judiciary, lawyers, senior government officers, IAS officers, police officers and IT professionals. She has been Visiting Faculty for cyberlaws at Amity Law School, the Indian Law Institute. National Institute of Financial Management and delivers guest lectures on cyberlaws in other reputed educational institutional of the country.
