Description
The digital economy has revolutionised how businesses operate, compete, and grow. As markets shift towards digital platforms and artificial intelligence, competition law faces unprecedented challenges in maintaining fair competition while fostering innovation. Competition Law and Digital Markets in India aims to address these pressing issues by exploring the evolving intersection of legal frameworks, technological advancements, and market dynamics.
This book begins with the foundational principles and evolution of the Competition Act, 2002, offering readers a thorough understanding of its origins, philosophy, and key provisions. It then delves into the complexities of anti-competitive agreements, abuse of dominance, and combinations, emphasising their relevance in the digital age. The recent amendments under the Competition (Amendment) Act, 2023 are critically analysed to highlight their implications for India's competition regime.
A significant focus is placed on the challenges posed by digital platform markets and artificial intelligence, particularly in areas such as platform dominance, cartelization, and algorithmic collusion. The book not only examines these issues within the Indian context but also draws comparisons with regulatory approaches in jurisdictions like the European Union and the United States.
In preparing this work, we have drawn on landmark case laws, current market trends, and academic scholarship to provide a balanced and practical perspective. Our objective is to equip readers with the tools to navigate the complexities of competition law in the digital economy while encouraging critical thought and informed debate on the subject.
We hope this book serves as a valuable resource for legal practitioners, academics, policymakers, and students, offering insights into the challenges and opportunities that lie ahead in regulating competition in India's rapidly evolving digital markets.
