Description
The first edition of this book was published in 2011 and has commanded overwhelming response from different clientele of readership. In fact, the book has over the years enjoyed the reputation of an authority on the Competition Act, 2002 and filled a void in legal thinking on the subject. There has been a significant growth of Competition Law at the National as well as International levels. The Second Edition maintains focus on all the statutory and other developments that have happened till date. There has been a usual flow of case-law. All the case decided by the Supreme Court, High Courts, Competition Appellate Tribunal and the Competition Commission of India since the last edition have been thoroughly studied and those that are considered helpful in exposition of the principles governing the Competition Law have been embodied at the appropriate places with fair amount of accuracy and precision. The Competition Appellate Tribunal has now been replaced by the National Company Law Appellate Tribunal constituted under section 410 of the Companies Act, 2013 by making necessary amendments in the Competition Act through section 171 of the Finance Act, 2017. On and from May 26, 2017, any appeal, application or proceeding pending before the Competition Appellate Tribunal stands transferred to the National Company Law Appellate Tribunal.
