A Compendium of Prison Laws aims to provide in a single book all the national and international rules/treaties governing the confinement of a person in the prison. From the global perspective, this compilation includes the international obligations arising out of the Nelson Mandela rules for the treatment of prisoners and the Bangkok rules for the treatment of women prisoners. At the domestic level it includes the guidelines laid down by the National Human Rights Commission relating to various aspects of prison administration such as a prisoner’s health, custodial violence, treatment of undertrial prisoners and premature release of prisoners. It also includes the periodic prison advisories issued by the Ministry of Home Affairs, the Model Prison Manual 2016 and various Acts governing the prisons of the country. The various judgments passed by the Supreme Court and High Courts on prisoners’ rights as well as the different aspects of correctional administration form an important part of this compilation. It also summarizes the rights and duties of prisoners as drawn from various judgments of the Courts. The language of the book has been kept simple so that every detail is easily understood and appreciated. Author Details
SUNIL KUMAR GUPTA began his career in 1981 working with Delhi Prisons in different executive capacities, including Spokesperson of Prisons Department. He initiated Special Courts or Jail Adalats' in collaboration with Delhi Judiciary for the disposal of petty offences. These special courts have settled thousands of cases of the poor and marginalised sections of the society and have earned appreciation from all quarters including the Chief Justices of India. Gupta also initiated the novel practice of securing the release of prisoners who were granted bail by the courts but were unable to arrange surety because of their poverty and backwardness. He also played an important role in introducing video conferencing facilities between the jails and the court, semi-open and open prison facilities for the convicts, and streamlining the process of grant of parole and furlough to the convicts. Gupta was instrumental in framing the Delhi Prison Act and Manual, as well as the Model Prison Manual of the Bureau of Police Research and Development, Ministry of Home Affairs. He retired from the prison services in July 2016 as the legal adviser of Delhi Jails. Post retirement, Gupta has worked with the Delhi State Legal Services Authority and the National Legal Services Authority, and provided important inputs in the matter of legal aid to the prisoners. He fought for gender equality within the prison system by ensuring that female prisoners can avail the same privileges of semi-open and open jails as male prisoners by filing a Public Interest Litigation. His achievements in the field of prison reforms and administration have carned him various national and international awards. Gupta is the only officer from the legal field to have received the President's Correctional Medal for meritorious as well as distinguished services. He currently practices at the Delhi High Court and the Supreme Court as an advocate. He is the author of the best-selling book, Black Warrant-Confessions of a Tihar Jailer.
