Description
This lucid and comprehensive work examines the Commissions of Inquiry Act, 1952, which was enacted to instill confidence in the citizens of the country in the administration and conduct of the government in respect of matters of public importance. The authors study the Act in its totality is origins and purpose, its use or misuse by succeeding governments, and its shortcomings. The detailed commentary provides a study of each provision of the Act, the litigation that has sometimes ensued challenging appointment of certain commissions, and the public controversies that have erupted on issues such as the appropriateness of the term of reference, the timing be appointment of commissions, criticism of the procedure followed by them well as the contents of their final reports, Perhaps most importantly, this book lays bare the key reasons why this statute, steeped in the ideals of the leaders of the freedom struggle, has been brought to such a pass that people have begun to lose faith in the relevance and efficacy of commissions. The authors present their own views on how the working of the Act may be made more effective and the confidence of the people restored. This painstakingly researched book will be of interest to the legal profession, the judiciary, public administrators and civil servants, the mall scholars and students of constitutional and administrative law, political science, and modern India, as well as all those in public life.
